My problems started in Oct/2008, my septic system started backing up, was told by city hall employee l could repair my own septic system, not needing a permit but city employee forgot to tell me if l put new gravel below and above the 5-6 pipes l had to replace was considered a new system. ( I guess l was to put back in human waste to re clog again).
Anyway was charged by health inspector told me had to have a new system in by June/2009 but couldn't get a loan then was charged again July/2009 finally was able to use home equity in Feb/2010 had to borrow $ 17, 000 to cover septic, legal fee new mortgage cost, cmhc etc.
Just. Co Landscaping came gave me a quote April/20/2010 for
$ 12, 285.00 that included all permits and new raised septic system installed and the cert papers for mortgage company.
Health inspector who charged me 2 times said septic system had to be in by May/14/2010.
Money from the bank was about 5-6 days past May/14/2010 deadline but inspector said to get permit quickly have it installed by first week of June.
I told contractor this contractor owner said no problem give me $ 1, 200
to get permit and pay for design and when l get deposit l will get permit.
May/13/2010 we signed papers at lawyers office May/18/2010 l gave the $ 1, 200.00 check dated May/17/2010 and a letter saying he would be paid balance of agreement when installed and cert papers given to the lawyer balance was $ 11, 085.00 when completed with papers for mortgage company.
They installed septic system nearly 7 weeks late July/20-23/2010, but left 2 huge pine tree's in my back yard and me disabled.
Also contractor covered up pipe that come out foundation wall it was leaking raw sewage into the ground.
I noticed wet area July/24/2010, asked contractor he said was leaking when they dug it up by hand July/20/2010 a lie l then asked why would you cover it up knowing was leaking raw sewage and not inform us the home owners he didn't reply a answer.
I asked his worker who covered it up 2 days latter he said they covered it with dirt so inspector wouldn't see it.
Today it is still leaking Sept/25/2010 l had to borrow another $ 1, 500 to have it fixed plumber coming next week.
Makes me wonder how many others he has burried and home owners don't know it as we didn't.
The check due to bank error July/19/2010 didn't go threw so l haave to now repay again for permit $ 670.00 so bank gets papers and cert paper lawyer paid contractor $ 12, 021.00 before cert was given plus the $ 1, 200.00 deposit in May/2010 $ 936.00 over agreed price plus l have to repay $ 670.00 not right.
Septic basically was put in with out permit as he never paid for permit from July/19/2010 to now.
Contractor never got electrical permit for hoking wires to panel box to septic alarm or a plumbing permit for pipe section leaking he covered up.
Even email reply says the money he wants extra he should have put in bid, inspector said contractors bid low then add latter most pay extra but not me.
Contractor said if l; don't pay is no warrantty on septic system he installed.
He never even showed me a bill to this day just talked threw my truck July/21/2010 all these increases then wrote on final bill l agreed to pay extra's anopther of many lies and misleading us.
Alarm in septic has gone off 2 times since installed July/2010 aam very worried about system and if he acts up he won't come repair it he said.
In original agreement was $ 585.00 GST as he could have done in may or June/2010 but was busy doing 8 other jobs his worker said.
He lied said inspector won't come on my property to inspect so designer had to charging me $ 330.00 for it yet inspector said was a lie and designer contractor knows has to inspect his work.
What can l do there is more details than above but have made long message as it is need help.
