Fraudulent Billing Practices

I've been fighting with World Health and my credit card company (BMO) for almost a year now.

When I first activated a membership with World Health I was quite clear with the rep setting up the membership: I did not want to be locked into a contract, I did not want the membership to auto-renew, and I did not want to give World Health any access to my banking information. In line with this I was told that I could set up a monthly membership that would require a higher fee paid biweekly, and that I could use my prepaid MasterCard to setup the account.

A few months later I started working a really heavy work schedule and a bunch of things got put on the back burner, including going to the gym. At this time I received a call from World Health and I was told that I had missed my last biweekly payment -- I was working a lot of hours and forgot to put money on the card -- and I would not be able to use the gym until my payments were up to date. In other words World Health had suspended my membership.

While on the phone I made arragements to pay the missed amount, including a late payment charge (despite the fact that it was billed to a prepaid MasterCard and incurred no costs for World Health), which I payed. And also, since World Health had suspended my membership (which I later discovered was in violation of section 12. (d) of the agreement), my payments were made in advance, and I didn't forsee being able to come to the gym on a regular basis because of my work schedule I told them I wouldn't be making any future payments as I wouldn't be using the membership anymore.

Because I didn't use the gym at any point unpaid, had paid for the full month even though I didn't use the facilities at all, and World Health had already suspended my membership I considered the matter resolved.

World Health on the other hand, even though they had been paid in full for all periods I had used the gym, and even though THEY HAD VIOLATED SECTION 12. (d) OF THEIR OWN AGREEMENT and had suspended my membership without waiting 30 days, FELT THAT IT WAS OK TO CONTINUE BILLING MY CREDIT CARD FOR A MEMBERSHIP I WASN'T ALLOWED TO USE. The disgusting thing is, BMO, the provider of my PREPAID MasterCard, as I was just told on the phone by one of their reps, feels that since I HAD A SOME POINT IN TIME an agreement with World Health, that this is OK and had no problem pushing hundreds of dollars of payments onto a PREPAID card that had a $0 balance on it.

So here I am, with a credit card bill on a card that never had a credit limit, and continuing to get monthly invoices from a company that violated their own agreements and hasn't provided a service for almost a year. But after looking on-line apparently I'm not the only one.
