Charge for missing batttery

I signed up for their plan and a free phone. Then I decided against it and sent the phone back and asked for another one, then returned it. Now they are saying the battery is missing and they are going to charge me $50. I told her I would cancel my contract with them. She said to keep looking for the battery. (Meanwhile the charge will go through)
