False contract for Home Protection plan Scarborough

A representative from Direct Energy contacted my husband to sell a Home Protection plan (heating and cooling maintenance). Since we have a new house my husband rejected the offer - our heating and cooling system is brand new, still under warranty. The rep insisted on sending us more information... just to get end the conversation my husband said: "sure". We received some papers from Direct energy informing us of this plan, which I immediately threw straight to the garbage.

A month later we started receiving bills and when we called to check why we are receiving bills, the answer was - "you have signed a contract". We haven't signed anything and the representatives were "kind" and said: "if this is a mistake, we will fix it, but it will take a while. If you receive a bill, just ignore it, while we are in the process of correcting your account. How hard could it be to void a contract that is false.

We keep receiving bills (3 months now) and every time we call they say the same thing: "it takes a while, probably 2 months before we can cancel." Last time they promised it will be fixed by Feb. 2008. That will be 5 months after the first bill we received and complained.

Our last bill (dec.) said we will be given to collections if we don't pay the bill. We have an excellent credit (up till now). I have no intentions on paying this bill and what worries me is that they are not asking for money, but keep telling us to ignore the bill as it takes time to fix. They were able to create this false "contract" and I believe this is not a first case. I bet they earn money like this from helpless people like us. Thank you for your input /suggestions
