In May of 2011, I was approached by the salesperson, Anne burns, about how she could save me money on my monthly debit machine tranactions. After numerous phone calls from her I agreed to give CollectivePos a try on June 2/2011. Anne burns came in late that evening and I signed contract for CollectivePos, she said that she would be back with a copy before submitting to her office. She never returned. I finally recieved a copy of my Contact on July 4/2011 by fax after calling for weeks. I was currently 3 months into a 2 year contract with Moneris Solutions, and was told by Anne Burns that when she came in to hook up my new Debit machine that she would take my Moneris machine and return it to Moneris and would handle all cancellation fees that would occur.
I was told by Anne that she did this all the time for her new customers. After receiving the machine from CollectivePos a few days later I called Anne to come in and hook it up. I waited 4 more days and finally decided to hook it up myself. I never saw Anne Burns again. I started to use machine and noticed that it was taking up to 72 hours to process Visa and Mastercard transactions. Upon calling CollectivePos I was told that I had to call FirstData who were the ones who handled these transactions, this was the first time I had been informed of a second party involved. I did not give them permission to access my bank account and being a small business I could not have my money tied up for 3 days. I was still paying for my Moneris debit machine which the salesperson never picked up or cancelled. I decided that CollectivePos had not lived up to there promises and decided to cancel contract with them. I spoke to Matt at CollectivePos and he sent me a cancellation form which said to return equipment back to CollectivePos. I filled out form and returned equipment to CollectivePos by courier.
Shortly after I was called by FirstData and CollectivePos regarding Cancellation fees and then finally by a third company NLS Leasing in Alberta. I had no knowledge of this third company and had not heard about them until I returned equipment. After numerous phone calls and pleas both FirstData and Collective dropped their cancellation fees and cancelled my contract. NLS Leasing on the other hand has not gone away. They currently have my equipment and are demanding that I pay $2200.00 to them or continue paying $34.99 monthly for the next 5 years or they will sue me. NLS Leasing calls daily for their payment.
CollectivePos concealed the fact that there were 2 other companies involved on my contract. On all sections of the contract CollectivePos has their stamp to lead their customers into believing that the contact is solely theirs. Only by close examination that you see the other parties involved. CollectivePos was the only company that I knowingly signed a contract with. I did not give FirstData Or NLS leasing permission to access my Bank account nor to deduct their fees.
In conclusion, NLS leasing has my equipment which they saw that CollectivePos Leased from them. CollectivePos owes this company their money not myself.
I am requesting that CollectivePos admit that they did not fulfill their part of the agreement that their salesperson promised and pay NLS Leasing back their money that they owe them. I returned the equipment as instructed on the cancellation form and in part have done what CollectivePos had instucted me to do. I do not have the equipment and therfore should not have to pay NLS Leasing.
