The owner of the restuarant sold the goodwill of the business to a kelowna resident, breached all the performance aspects in the contract, solicitating a contract against public policy, demanded payment of $100, 000. (remaining amount was offered to settle for a total of $81, 500. Before the new owner could respond they have now resold this business evicting the purchaser. Failing to disclose the company is in arrears with revenue canada, wcb, they now have convinced a new buyer to take over without repsonding the dispute first.
We would like to warn possible new buyers, and inform them to search all aspects of their credit, tax arears, ect. Do not just rely on a lien search.By all means this was a trusted couple known by the purchaser for over 5 years. Buyers, it is not always right to go on trust. We will keep you informed on the outcome of our pending lawsuit, and we will let you know what the new owners are doing, if they are able to keep the business etc. Crazy but very true... this can take months before a judge may hear our claim but hopefully they will stick around and face their purchasers.
