When you read this please keep in mind that I was recovering from surgery after an auto accident and having to deal with this fraud.

On 5-02-07, I won an auction for the: 'IGIA PERFECT HANDS NAILS ULTRA VIOLET MANICURE SET NEW' eBay item#260112095761. After they said they never received my payment and after I declined to pay again thru PayPal or credit card or debit card they threatened to launch an investigation if my payment was not received by Friday May 18th, 2007 and promised to contact me before he opened an investigation to find out what I discovered through the U.S. Postal service inquiry. I told them I would check with the US Postal Service in the meantime to see if my Postal Money Order had been cashed yet.
On Thursday the 17th a non-pay bidder dispute was opened by You-Can-Save, against me. I contacted You-Can-Save again on the 22nd and was informed that the payment had been found but they wouldn't tell me when it was processed or deposited or when I could expect my item to be shipped. I asked if the dispute was closed yet and they couldn't tell me that either but they said the item was being prepared to be shipped. When I hung up the phone I checked ebay and the dispute was not closed so I submitted my response with them. Not 2 minutes later, UPS was at my door with a package from wonderfulbuys.com. You-Can-Save didn't tell me that they would ship my item under that name. I opened it and found a used manicure kit with no light and no tools without the retail box.

I immediately called You-Can-Save and spoke with Nelson who tried to argue that they sent the correct item and that I didnt know what I bought. I told Nelson that I would not be sending the first one back until I verified the item was correct and complete. Nelson said he would enclose a return label with the second shipment. When I hung up the phone, I called the number on the box for the return address for wonderfulbuys.com and was surprised to hear Nelson state his name when he answered the phone because when I spoke to him previously I asked him if wonderfulbuys.com was their drop shipper and if the address I sent my payment to in Canada was only for accepting payments and he said yes.

After I hung up the phone the second time, I checked the feedback rating for this seller and found that I was only one of many who had been scammed by this seller. I then reported You-Can-Save as a fraudulent seller with eBay, nothing became of it. eBay still hasnt done anything to penalize You-Can-Save. They havent properly mediated this situation at all in my opinion. This was an eBay verified PowerSeller that did this and got away with it on eBay. On 5/31/07 I received a 2nd incorrect & incomplete item from You-Can-Save again with no retail box. This time when I called I spoke with a Frank Joseph who said I would need to talk to Shawn Wilson to discuss a refund and that he would call me within 48 hours to do so. (this was usually the case every time I called You-Can-Save looking for Mr. Wilson) he also stated that they dont have a copy of the auction in their system and to please send a copy to Shawn Wilson via e-mail. This is a copy of the email I then sent to Shawn Wilson:

ATTN: Shawn Wilson
as requested by frank joseph at you-can-save, stating you needed a copy of your own auction before you could send me the correct item. So far, you have sent me two incorrect and incomplete items. You have sent me platinum nails not what the auction was for= perfect nails. I await your response within 48 hours.
He never called me back. He never e-mailed me either. Finally on 6-20-07 I called You-Can-Save again asking to speak with Shawn Wilson I had to speak with Nelson again because Mr. Wilson was out of the office. I updated Nelson on what was going on and said that I was still waiting on Shawn to contact me again, he began to insist that Mr. Wilson called my house and left several messages on my machine and emailed me too. He started to get nasty. I told him that it wouldnt help him to get nasty because I had checked the feedback for You-Can-Save and found that I wasnt the only one that they did this to. I also stated that because I paid with a US Postal money order and they accepted the money for a product they didnt deliver that they were now committing mail fraud. I notified him that I just had surgery in April and I was home all that week still recovering and that I never left the house. At this point I demanded a full refund including shipping and handling, again Nelson tried to get credit card or bank account or PayPal information from me stating that the refund would be quicker that way. I told him to send a postal money order just like I sent to them. He said it may take up to 2 weeks to process my refund and even longer before I receive it and that Mr. Wilson will email me with a confirmation number. It never happened. It is now July 18, 2007 and still no refund. I dont know why Id be surprised. After 1 hour and 47 minutes of being on hold today with You-Can-Save I decided to do something about the situation. I am in the process of contacting the correct authorities.
