MDG attempted to sell me a defective Visionbook Pro 3050 XD notebook along with defective software. MDG also attempted to sell me the 2007 MS Office Student/Home edition when I specifically ordered the 2003 MS Office Student/Teacher edition.
Originally I had to return all items within a day of recieving them. The notebook was suppose to be replaced as well as the software.
When MDG shipped back the items they shipped back the same notebook. I had to phone them to find out why. They claimed that they fixed the notebook. The software they replaced was not the same software I originally ordered.
Within a few days of recieving the alleged fixed notebook I discovered further hardware problems (the curser was operating on a mind of its own). I then decided to cancel the contract and return the items.
After exchanging a number of correspondence and phone calls MDG agreed to cancel the contract. But before they did that they tried to deliver the items back to me. Of course I refused all deliveries from MDG.
Now, although MDG agreed to cancel the contract they insisted that I pay a re-stocking fee of 20 % of the total purchase price - $233.23.
I reminded MDG that the product was defective and because of that I was not obliged to pay them anything.
Of course MDG disagreed. Now they are threatening to file a report to the credit bureau and file a claim with the Superior Court of Justice. MDG also alleged that I would be stuck with their legal costs of over $3000.
I responded to their demand letter advising MDG that I do not agree with their position and that if they filed a report with the credit bureau I would take legal action.
There are a number of consumers across Canada that have been in contact with me that have similar experiences.
So, if MDG files a claim against me I will ave at least 3 to 4 witnesses that will support my defence.
MDG didn't take into account of my 16 yrs of military service (of which I was a drill instructor for 10 yrs) and 7 yrs experience as a paralegal litigator (as well as entering into my degree studies in criminology/criminal justice)
