Selling second hand used, dirty, scratched, broken items

Item #1 - scratched/dirty the battery tab was pushed so far in you can't remove to activate product.
Item #2 - scratched/dirty
Item #3 - open package, used
Item #4 - open package stapled closed
Item #5 - open package stapled closed
Item #6 - scratched/dirty with dead batteries

They claim they don't sell used, open products, but later in emails admitted they open the products to test they work. Which doesn't then explain why the one item arrived with dead batteries. They then said they would refund but charge 50% restocking for open items, which they had admitted they opened. After several emails they refuse to refund or give an RMA#. And Paypal won't do anything because, they can only refund the money if the items did not arrive, and the condition they arrive in doesn't matter.
