Faulty installation, missing part, no respose to fix problems

Alternative Enterprises sold us a BISS NOVA fire place system in June 2011.

1) A part to close the outside air supply to divert the air from entering the house and into the fire box has been promised for at least six months and still not delivered.

2) I reported and requested fixing a chimney leak since October 2011, they said nothing can be done because it is condensation. I talked to a technician that supplied them with the chimney parts, he told me that the leak is cause by faulty installation of the flashing. He also explained that if it is condensation the leak would happen on the outside of the chimney whether there is snow on the roof or not. Since I could not get them to fix the leak I had a roofer check it, he told me that the flashing was not sealed right, and when they responded by adding more caulk it did not help. I had him replce the flashing and sent them the bill, they refuse to pay.
