MCAP's Gross Negligence

Having been made redundant at the end of 2007 the Giblett's mortgage company, MCAP, offered no assistance during this time. Mr Giblett told MCAP of his redundancy immediately it occurred, their attitude from the outset was one of irreverence. Being out of work Mr Giblett received some severance pay and also had some savings and other assets on which the family could rely. Immediately he asked the bank for a method other than direct payment in order to make payments, MCAP offered no assistance here. The bank went on trying to collect payments eventhough they were told that money was not likely to be in Mr Giblett's account. Every time a payment failed MCAP subsequently collected $75 for the failure to pay, stupid considering they had been told not to attempt to collect.

Eventually the family's money ran out. Once the mortgage was one and a half months overdue MCAP illegally initiated 'serious default' proceedings against the family. I say illegally here because the mortgage must be over two months in arrears in order to take such proceedings. Again interestingly ANY REPUTABLE MORTGAGE COMPANY will use the foreclosure route against delinquent payers, which allows a person in default a reasonable time to correct the situation.

Having illegally evicted the family from their home on March 5th 2009 MCAP deliberately and wilfully acted to prevent an ongoing negotiated sale of the property and wilfully and negligently flooded the basement of the house. Their action has ended any possibility of sale and has decimated the value of the property.

This property, is a country property and requires special maintenance consideration. As we assume the average reader lives in the city we should tell you that in maintaining of a country house requires different consideration than an urban property. You need to think about the well that supplies the water to the house and basements must be protected from flooding.

On March 5th 2009 MCAP's representative wilfully or negligently did not turn off the well pump causing a flood into the garden area. At this point in time MCAP have by their actions taken responsibility for maintaining the property and they have clearly been grossly negligent in their duty. and looking at other complaint on this board I get the impression that they have an ongoing conspiracy to defraud home owners of their properties.

When closing up the propert on March 11th or 12th 2009, or on a subsequent visit MCAP's property maintenance company switched off both sump pumps in the basement. This action caused a flood in the basement of water that contained the e-coli virus (normally kept at bay by the sump pump). Water damage of this type can cause major issues for any property. The picture to the right shows the affect of black mould (Stachybotrys) on a basement wall. The impact of such a flooding typically promotes the growth of several highly allergenic and potentially toxigenic (toxic to humans) fungi. Long-term leaks promotes the proliferation of the highly toxigenic fungi. This has made the house inhabitable in the foreseeable future.

On the day the Giblett family left the property (March 5th 2009) the house and garden were in good condition.
