$3, 500 voice messaging system lease to buy plan still not installed since 1999. RIPOFF

A voice mail system I purchased on a lease to buy plan from Telephone Magic Inc. is still not installed after more than 5 years. The original lease agreement is dated January 1, 1999.
(66 months @ $79/month taxes =$90.85/month.)
Total value of lease $5, 214.

The contract was to include all the hardware required for the operation of voice mail on my existing phone system as well as full installation on three existing phone lines. The hardware was delivered almost immediately.

In order to get the voice mail actually installed, messages needed to be composed and recorded. I was told that a pofessional could record the messages for me or I could do so with my own voice. I thought the second option would be appreciated by my clients and would feel more personal so I opted for that. However, after a year, I still had not had time to record the messages so I called and asked to have the professional recording instead. To my surprise, I was told that it was too late.

No one had ever mentioned to me that I had to deal with this within a set period of time. I assumed that the relationship was ongoing with this company until the terms of the contract were fully fulfilled.

I was very upset and did not know what to do. I continued to pay the lease. I called the leasing company to ask if there was something they could do to put pressure on Telephone Magic to honour their part of the agreement. They insisted that there was no connection between them and the company and that I needed to pay the lease or risk bad credit rating.

I continued to pay the lease until 2004 at which point there was less than $850. outstanding and I again thought that holding payment might put pressure on Telephone Magic to honour their commitment. I did that and when the leasing company sent a notice that I was in default, I wrote them a registered letter outlining the case. They understood my problem but could not officially take any action on my behalf. They did however admit that there had been problems with Telephone Magic and they contacted Telephone Magic on my behalf albeit unofficially.

Telephone Magic agreed to come but insisted that I pay for the service and wouldn't come unless I signed a faxed contract whereby I agreed to pay them displacement fees and an hourly rate. I protested but eventually signed. This was February 4th, 2004. I seem to remember that charge came to some $300.

They did nothing but inspect the hardware. They found a couple of my phones (I have 11 stations) were not working well and offered to replace the units. They called for a price and were told $300. each. These units were selling for $75. on the Internet at the time. They were still looking for opportunities to milk me for every cent they could get! I did not buy them. They asked that I fax the text of the messages I needed them to record which I did on February 17th.(Attention Rolland) I never heard from them since.

The voice mail system is now fully paid and has never worked. My research has determined that this company has had numerous customer service issues in the past and my experience with them demonstrates fully that they have absolutely no interest in customer service. All they care about is dumping their outdated hardware and collecting their money. A lease agreement is the best thing for them. They get paid right away and wash their hands of any service related issues.
