Hyperformance
Non receipt of goods post payment

In Sept 2007 I ordered 2 racing seats, my credit card was billed immediately. After 6 weeks called to find out what happened and was told selected seats were on back order. I was offered alternate seats (bait and switch) which I agreed to accept on the condition the seats were grey. Seats arrived 2 weeks later, black, not grey, and badly damaged due to poor packaging. Immediately returned seats via UPS, hyperformance denied receipt. Provided proof of delivery and asked for full refund. Refund denied by "Pam" as refunds "against company policy". Threatened legal action and 3 months later received a personal cheque which was short $194 from what I was originally billed. Complained and was told $194 deducted for shipping costs of seats (which were black, not grey as promised, and damaged).

Threatened legal action again, was offered store credit for $194 but every item I selected was "out of stock"

Filed complaint with Better Business Bureau, response provided to BBB frfaudulent, claimed product shipped to me was damaged by me. BBB advised that despite proof provided by me that Hyperformance reply was fraudulent, BBB could do nothing more as company not a member of BBB.

February 2008 started sending constant E-mails to "Pam" which were never answered. Eventually contacted by Hyperformance customer service and was promised $194 refund (in writing via E-mail) if I would stop constant E-mails. When no refund cheque received, started constant E-mails again. Then contacted by Pam who said customer service did not have the authority to offer a refund, again offered store credit. Item after item selected again out of stock. Offered car alarm and corner lights. Agreed to accept these products and as soon as I did, hyperformance stopped responding to my E-mails and constant phone calls. Have begun constant E-mails again hoping to crash their E-mail system.

Now 23 months since initial order placed... DO NOT DO BUSINESS WITH THIS COMPANY. ANYONE INTERESTED IN LAUNCING A CLASS ACTION LAWSUIT TO PUT THESE PEOPLE OUT OF BUSINESS BEFORE THEY RIP ANYONE ELSE OFF CAN COUNT ON MY SUPPORT!
