BEWARE! I lost over $6, 000 in a finance contract flipping scheme. Ripoff

While working under contract for Landmark Vehicle Leasing the President, Mark Emin, re-leased the BMW I was leasing from Landmark Vehicle Leasing without my prior knowledge or informed consent. He basically pocketed over $5, 000 in profit on my original lease by securitizing it and then terminated my lease, buying out the finance contract using my $6, 375 of down payment I had made on the lease.

He then re-leased the car to another customer and pocketed $7, 000 in profit on that lease by re-securitizing the same car with the same finance source, Corpfinance International Limited, in addition to the over $10, 000 in upfront fees and a security deposit Landmark Vehicle Leasing got from the new customer. Unbelievable!!

I sued Landmark Vehicle Leasing and recently (after over 2 years of them dragging it out) have been awarded a judgment against Landmark Vehicle Leasing from the Superior Court of Justice, Richmond Hill Small Claims Court in the amount of $9, 662.23 plus costs of $150 and pre-judgment interest of $648.56 - a total of $10, 460.79.

In the judgment, the Judge out rightly rejected the defense's arguments on all matters including the re-leasing of my vehicle. In fact, referring to the testimony of Landmark Vehicle Leasing's President Mark Emin, The judgment states, "In all aspects where the testimony of the parties may differ, the court prefers the evidence of the Plaintiff in preference to that of the witness for the Defendant. The court finds the testimony of that witness unreliable, evasive and unacceptable on an issue of credibility."

Since receiving the judgment, dated September 9, 2005, I have made several attempts to contact Landmark Vehicle Leasing's legal agent, Stuart Raskin, as a courtesy to arrange settlement and avoid enforcement proceedings, garnishments and seizure and sale writs. Mr. Raskin, formerly with Landmark and now with Raskin and Associates, has not returned any of my calls and it would seem that Landmark Vehicle Leasing has no intention of voluntarily honoring the judgment.

The post-judgment interest clock is ticking at 4%.

BEWARE when dealing with Landmark Vehicle Leasing. If this is the kind of treatment Landmark Vehicle Leasing gives to its employees and business associates, just imagine what they do to their regular customers. I have some interesting stories and would be interested in hearing from anyone who has had unusual or unethical dealings with Landmark Vehicle Leasing.
