Unauthorized Lien on House

I was in the process of renewing my mortgage last week when I found out that they had put a lien on my house 4 years ago when I leased an air conditioner. They did not tell me this, nor could my lawyer find anything in my paperwork that indicates they were going to do this or that they had my permission. I called and tore a strip off some poor individual on the other end of the phone, but all I got was instructions on the process to have them moved down to #2 on my mortgage so my mortgage company could have #1. No explanation, no information on who to contact to find out more info, I was just told that it must be legal because they do it all the time. My lawyer is pretty sure it’s not legal, just hasn’t been pursued because no one has tried to do anything about it. I don’t have the resources to take the company to court over it, and I have told them that I will continue to abide by my end of the contract and pay monthly for three more years. The same thing happened to my neighbour, and my lawyer said she’s heard from quite a few people that they found out about the lien when they renegotiated their mortgage as well.

I am also ticked because they leased me a $7800 air conditioner when I was a newly single mother trying to keep my house. The only way I could afford a new air conditioner (mine wasn’t working anymore), was to lease. I was told this was the energy efficient model and the only one I could lease. In the four years since I have had this thing installed I have never seen a bigger unit on any house, and mine is only 1200 square feet. I was completely taken advantage of.
